Terms & Conditions, Privacy & Refund Policy
These terms apply to all digital products and services offered by Magicneer, including but not limited to Magic Trip and any future effects or tools built for digital magic and mentalism.
1. Terms & Conditions
These Terms & Conditions ("Terms") form a legal agreement between you and Magicneer ("we", "us", "our") governing your purchase and use of our digital products, licenses and any related materials.
1.1. License grant
When you purchase a Magicneer product, you are purchasing a personal, non-transferable, non-exclusive license to use the software and method for your own professional or hobby performances, subject to these Terms and the continued operation of the service and its third‑party integrations. You do not own the underlying intellectual property.
1.2. Permitted use
- Use Magicneer products in your own performances (live or online) for entertainment purposes.
- Install and use the software on your own devices as needed to perform.
- Create and manage passes, cards or digital assets for spectators as part of your performances, where applicable.
1.3. Prohibited use
- Re-selling, sharing, renting or redistributing your license key or access to the service.
- Publishing, teaching or exposing the method or internal workings of any Magicneer product.
- Using our products for any illegal, abusive or harmful purpose.
- Allowing multiple performers to use a single license without our written consent.
1.4. Support & updates
Your license includes access to the current version of the Magicneer product you purchased at the time of purchase and to bug-fix updates we may release. We may add, change, suspend or remove features or integrations over time (for example, if Apple Wallet or Google Wallet change their technical or policy requirements) in order to maintain stability, security or legal compliance. Reasonable email support is provided on a best-effort basis.
1.5. Disclaimer of warranties
Our products are provided "as is" without any express or implied warranties. We do not guarantee that any effect will be error-free, uninterrupted or compatible with every device, operating system or wallet provider. You are responsible for testing the effect in your working conditions before performances.
1.6. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim related to our products is limited to the amount you paid for the relevant license. We are not liable for indirect, incidental, special or consequential damages, including loss of income or reputation.
2. Privacy Policy
We respect your privacy and are committed to protecting your personal data. This section explains what data we collect, how we use it and how it is shared.
2.1. Data we collect
- Contact details: your email address and, if provided, your name.
- Purchase information: product purchased, price, currency, country and transaction identifiers.
- Payment details: processed securely by our payment provider, Paddle. We do not store your full card details on our servers.
- Technical data: basic logs such as IP address, device type and browser, used for security and abuse prevention.
2.2. How we use your data
- To process your purchase and deliver your license key.
- To create and manage your Magicneer account and license status.
- To provide support and respond to your requests.
- To improve the reliability, security and performance of the service.
2.3. Third parties and data sharing
Payments are processed by Paddle, who act as our payment provider and Merchant of Record. Paddle collects and processes payment-related data in accordance with their own Privacy Policy. We may share limited data with trusted service providers (such as email delivery or analytics) strictly for the purposes described above.
We do not sell your data and we do not share personal information with third parties for their own marketing purposes without your consent, unless required by law.
2.4. Data rights and contact
Depending on your location, you may have rights to access, correct or delete your personal data, or to restrict certain types of processing. To exercise these rights or ask any question about privacy, you can contact us at magic.special.alex@gmail.com.
3. Refund Policy
Refunds are permitted within 14 days of purchase. Details are set out below.
3.1. Refund window
You may request a full refund before 14 days have passed since the date of purchase. To request a refund, contact us at the email address below with your order details. After a refund is processed, your license will be revoked and you must cease use of the product.
3.2. Technical issues
If you experience technical problems that are demonstrably caused by issues on our side (for example, service outages or critical bugs that prevent the product from functioning as intended), we may consider a refund on a case-by-case basis, even after the 14-day window or license activation, provided the issue is verifiable and justified. This clause does not apply to changes, limitations or disruptions caused by third-party platforms or providers (such as Apple Wallet or Google Wallet) that are outside our control.
3.3. How to request a refund
To request a refund, contact us at magic.special.alex@gmail.com from the same email address you used to purchase the product, including your order ID and license key. We may ask for additional information to verify your identity.
3.4. Chargebacks
Please contact us before opening a dispute or chargeback with your bank or payment provider. Unjustified chargebacks may result in the permanent disabling of your license and account.
